Conservation Commission

The Conservation Commission conducted its October 6, 2025 virtual meeting addressing multiple permit matters, site reviews, and administrative actions. Commissioners continued several hearings pending additional materials (including the NOI for 61 Lake Attitash Way and ANRAD 131 Haverhill Road, with a peer review and site-flag confirmation ongoing), reviewed DEP comments on the 501 Main Street retaining wall proposal, and discussed the temporary substation proposed within the Mill Street ROW which will require stormwater peer review and a restoration plan. Commissioners also held a site visit to assess flagged boundaries and reviewed project access and construction means-and-methods for several shoreline projects.

The Commission made several final determinations: it issued a Negative Determination for RDA 8 Noel Street (finding the area not jurisdictional BVW); approved NOI 002-1353 (93 Whitehall Road) contingent on a 10'x15' native vegetation mitigation/planting plan; approved the Certificate of Compliance RCOC 002-1342 for drainage maintenance along I-495 Northbound; approved release of the bond for 12 South Hunt Road; accepted and then approved a minor modification for DEP 002-1330 (2 Merrimac Street) subject to implementation of the proposed mitigation plan; and ratified an Emergency Certification allowing removal of a fallen tree branch at 30 Lake Attitash Road. Significant substantive discussion included DEP feedback requirements for 501 Main Street (bank/BLSF depiction, performance standards, construction access easement), the need for stormwater peer review for the Mill Street temporary substation, and applicant commitments to shoreline mitigation plantings at Whitehall Road. Applicants clarified access easement use and construction timing in public discussion; no contested public testimony from outside parties was recorded in the minutes.
