Conservation Commission
The Commission continued the Rocky Hill MBTA Community Development Project hearing (DEP 002-1362) to September 8 and requested Beta (peer reviewer) attend. The Commission also issued a Certificate of Compliance for the retaining wall work at 26 Merrimac Street (DEP 002-1343).
The Commission reopened the Rocky Hill MBTA Community Development Project (DEP 002-1362) for an update. The project team reported submitting supplemental materials and responses to peer reviewers (Beta and VHB) and noted a small additional wetland impact (5 sq ft) associated with a boardwalk. Commissioners discussed outstanding peer review items including an acreage discrepancy in the proposed restoration area (originally ~8,870 sq ft vs. a current proposed 11,031 sq ft), maintenance and an operations & maintenance plan for a proposed wildlife/culvert crossing, requirements for erosion control and stormwater monitoring during construction, and invasive species management methods and monitoring. A substantive policy issue was debated regarding whether portions of riverfront area already used or cleared for agriculture within a bordering vegetated wetland should be counted as degraded (Beta comment 17) and a related DEP Northeast interpretation about whether riverfront areas may be split into degraded and non-degraded portions or must be treated under a single standard (Beta comment 20). The Commission requested written DEP clarification and resolved to have Beta attend the September meeting for face-to-face discussion rather than continue with dueling memos; the Rocky Hill hearing was continued to September 8 with Beta in attendance.
Other hearing actions: the Commission agreed to continue multiple pending NOIs — 29 Lake Attitash Rd (002-1360), 4 Lake Attitash Rd (002-1364), 28 Haverhill Rd (002-1365), and 3 Old Merrill St. (002-1367) — to the September meeting. The Commission voted unanimously to issue a Certificate of Compliance for DEP file 002-1343 for the retaining wall at 26 Merrimac Street after reviewing as-built documentation and compensatory flood storage estimates. On administrative matters Commissioners discussed improving the local filing checklist to address local ordinance/performance standards and the 21-day hearing timing issue, options for conditioning conservation restriction timing (occupancy/permit triggers), MACC training availability, and planned follow-up with DEP for written clarification on riverfront interpretation and hearing-deadline practice.
