Battis Farm - Amendment

What is proposed

This document is a Certificate of Compliance (WPA Form 8B) issued by the Amesbury Conservation Commission under the Massachusetts Wetlands Protection Act (M.G.L. c. 131, § 40). A Certificate of Compliance is the Commission’s formal determination that work regulated by a previously issued Order of Conditions has been completed in accordance with that Order.

The Certificate on file indicates a Complete Certification for work governed by an Order of Conditions dated April 20, 2022 (DEP File Number 002-1302). The Certificate names Sharon & David Nash as the parties on the form; City records also associate the project with David C. Nash and list the filing type as an Amendment.

Where and how big

The project site referenced by the Certificate is 41 Paige Farm Road in Amesbury (the project is also referred to in project context materials as Battis Farm). The Order of Conditions that regulated the work is recorded at the Essex South Registry of Deeds (Book 41079, Page 512).

The Certificate of Compliance form does not include design-level quantities (for example, building square footage, number of units, or construction materials). Those technical details are found in the original Order of Conditions, the approved plans, and the Notice of Intent on file with the Conservation Commission.

Wetlands, resource areas, and permit details

The Certificate and associated paperwork are administrative actions under the Wetlands Protection Act. An Order of Conditions is the wetlands permit that specifies what work is allowed in or near regulated resource areas (for example, bordering vegetated wetlands, streams, or floodplains) and lists any conditions such as erosion controls, planting, or monitoring requirements.

The Certificate form provides space to list any ongoing conditions from the Order that remain in effect (such as required maintenance or monitoring). The copy of the Certificate available for this record references ongoing conditions by number but does not include the text of those conditions; to see specific permit requirements, consult the full Order of Conditions and the Commission file for DEP File 002-1302.

Parking, access and transportation

The Certificate of Compliance itself does not describe parking, driveway locations, or changes to public roads. If the approved project included changes to access, parking counts, or site circulation, those elements would be documented in the project plans and in the Order of Conditions on file with the Conservation Commission.

Status and next steps

A site inspection accompanying the Compliance determination is recorded as having taken place on July 17, 2023. The Amesbury Conservation Commission issued the Certificate of Compliance on August 7, 2023. The Commission’s April 3, 2023 vote authorized use of electronic signatures; the Certificate lists several Commission members by name.

Under the form’s instructions, the applicant is responsible for ensuring the Certificate of Compliance is recorded at the Registry of Deeds. The Order of Conditions itself is already recorded at the Essex South Registry of Deeds (Book 41079, Page 512).
